Good afternoon, my name is Jose, the reason for this interview video is to give you an idea of the importance of having the right people working for you, when you're faced with difficult decisions in life.
Back in 2007 I was working for a company, a check cashing company, one of the largest, if not the largest one in South Florida. At the end of 2007, beginning of 2008, while working for the company for two years already, we were stormed in by the IRS agents, police departments throughout Miami-Dade County, and we were arrested, myself and two others from the company.
Having been indicted and never have had a problem in my life before concerning the law, I was shocked and my whole family started to worry about what could happen, I was atthat time facing 15 to 18 years prison time if convicted.
A few weeks of interviewing various attorneys, I came across one person that was recommended to me, by the name of David Garvin. I did not know David at that time, had never met him before, the only reference I had of him was from my brother-in-law and a couple of other people that spoke very highly of him, and I decided to go ahead and go talk to him.
During the time that we spoke, that initial interview, one of the things that David product to me was, the fact that, when you're choosing an attorney is like choosing a surgeon. You may be considered innocent until proven guilty to people that are outside the situation, but when you're going up against the United States of America in a court of law; you are the one that has to prove your innocence, whoever tells you that you're proven innocent until guilty, it is totally giving you a story, that you'll find out sooner or later is totally false.
During the trial, we were faced with videotapes of me, at the location, signing the items, talking to, what was an informant at that time, and those were things that were highlighted more and more by the other defendants' attorneys, trying to lay the blame, mostly on me. After the end of the trial, I was found to be, not in the terms of not guilty but it was a hung jury, and as a defendant getting a hung jury, is the next best thing to getting acquitted.
Your chances are very low when you're going up against the government, as mostpeople will tell you. And from based on talking to the jurors I was told that it was in my favor 8 to 4. If it weren't because of David, I would not have fared as well as I did; there is no doubt in my mind.
We actually went over things, we would discuss things, he would give me the options, you're talking about facing 15 years. If you want to go to trial we can go to trial, these are your pitfalls, these are the things these are your strengths, we started going everything, we, it got so detailed, we even put a lineup as to the witnesses that we were going to use, and the order that we were going to use them in.
And people that may not think that's important, that was crucial to my defense. I was the last one to testify, it was grueling, and no matter what, there was not one time during the trial; honestly, one time during the trial, where I felt that I was losing it. Unfortunately for my co-defendants, one of them, he was found guilty and is serving 18 years in prison, for the allegations.
The trial was even more difficult for me because I was tried along with people that were actually found to be guilty, and when they're, when somebody's got their back against the all they're gonna do is try to go ahead and lay the blame off on someone else.
David did not go into blaming other people, his intentions were to prove my innocence, and my innocence was proven on at the end. And that's a testament to my family which I'm blessed to have. And, also to, and in large part, to tell you the truth to David Garvin; there's no one else that I would highly recommend to do anything more than David.
